Terms of sale
General terms and conditions of sale
What we commit to when you order, and what we expect of you. Plainly, with no needless jargon.
1.Who sells, and to whom
These terms govern every order placed on carnetevasion.ch with:
Placing an order constitutes acceptance of these terms in the version in force on that day. We sell to private individuals as well as to businesses, in Switzerland, Liechtenstein and Europe.
2.Our creations
Each piece is made by hand, to order. That is what makes it special, and it implies two things you should know before buying.
Slight variations are normal. The grain of the wood, the exact shade of a fabric, the placement of a design to the millimetre: no two pieces are ever strictly identical. The images on the site, including personalisation previews, are faithful representations but are not contractually binding to the pixel.
What you write is what we engrave. We reproduce the personalisation text exactly as you enter it, without correcting spelling, accents or capitalisation. Check it before confirming: a typing error faithfully reproduced is not a manufacturing defect.
3.Prices
Prices are shown in Swiss francs (CHF), per item, excluding delivery costs. Value added tax is not applicable: our turnover is below the registration threshold of Art. 10 of the Swiss VAT Act.
The applicable price is the one shown when you confirm your order. It is recalculated from our catalogue at the time of payment: the content of your basket cannot change the amount.
4.Placing an order
You choose an item, personalise it, add it to the basket, and are then redirected to our payment provider. The sale is concluded when payment is confirmed.
You then receive a confirmation email summarising your order, its personalisations and its reference. If you do not receive it within the hour, check your spam folder, then write to us.
We reserve the right to refuse an order for a legitimate reason — a personalisation text that is unlawful, offensive or infringes the rights of a third party, a manifestly fraudulent order, or technical impossibility. In that case, you are refunded in full.
5.Payment
Payment is made online, on the secure page of our provider Stripe. The accepted payment methods are shown there at the time of payment.
No bank details pass through our site, and we keep none. The order only goes into production once payment has been received.
6.Making and delivery
Allow 3 to 5 working days for making, then delivery: 2 to 4 days in Switzerland and Liechtenstein, 7 to 12 days to the rest of Europe — 5 to 9 days or 10 to 17 days in all. These times are indicative: they run from confirmation of payment and may be longer during busy periods. We will let you know if a significant delay arises.
Delivery costs are CHF 7.00 per order in Switzerland and Liechtenstein, free from CHF 60 of purchases, and CHF 15.00 to the rest of Europe (European Union, United Kingdom, Norway and Iceland), with no free threshold. Any customs duties and import taxes are your responsibility.
You are responsible for the accuracy of the address entered. A parcel returned because of an incomplete or incorrect address may be re-sent at your expense.
The risk of loss or damage passes to the buyer when the parcel is handed to the carrier. In the event of loss or obvious damage, we file the claim with the Post Office and support you until it is resolved.
7.On receipt
Inspect your parcel on arrival. If the packaging is damaged or the item spoiled, let us know within seven days, with a photo if possible. After that, transport damage becomes very difficult to get recognised.
8.Returns, exchanges and cancellation
Under Swiss law, online sales carry no statutory right of withdrawal — the revocation period of Art. 40a of the Code of Obligations only covers doorstep and telephone selling. What we grant below is therefore a commercial commitment on our part, not an obligation.
- Personalised items: no returns. A piece bearing a name, a date or a text chosen by you can be neither resold nor reused. It is therefore neither taken back nor exchanged, except in the event of a manufacturing defect or an error on our part.
- Non-personalised items: fourteen days. Send them back in their original condition, complete and unused, within fourteen days of receipt. Return costs are at your expense; we refund the price of the item within ten days of receiving it.
- An error on our part: we remake it. Wrong design, a mistake we introduced, an item damaged on arrival: we remake it or refund you, as you prefer, at no cost to you.
Cancelling before making: write to us as soon as possible. As long as the piece has not been started, we cancel and refund in full. Once the engraving or printing has been done, this is no longer possible.
9.Warranty for defects
The statutory warranty for defects under Art. 197 et seq. of the Code of Obligations applies: an item with a material or manufacturing defect is repaired, replaced or refunded.
Report the defect as soon as you discover it (Art. 201 CO). Normal wear, damage resulting from improper use and the variations in appearance described in section 2 are not defects.
10.Liability
Our liability applies within the limits provided by law. It may not exceed the amount of the order concerned, except in the case of gross negligence or harm to life or health, where no limitation applies.
You guarantee that you hold the necessary rights to the texts and elements you ask us to reproduce, and you alone are liable for any infringement of third-party rights that may result.
11.Personal data
The data collected to process your order are described in our privacy policy, which sets out who they are passed to, how long they are kept and how to exercise your rights.
12.Applicable law and jurisdiction
These terms are governed by Swiss law, excluding the Vienna Convention on Contracts for the International Sale of Goods.
The place of jurisdiction is the seller's registered office. If you are a consumer, this clause does not deprive you of the right to bring proceedings before the court of your place of residence, which the law reserves for you.
Before taking any action, write to us: almost every dispute is settled by an exchange of emails.
